Maximum Adjusted Leverage Ratio. The Borrower will not permit its Adjusted Leverage Ratio at any time during any fiscal year to be greater than 15 to 1.
Maximum Adjusted Leverage Ratio. H&E Holdings and its Subsidiaries on a consolidated basis shall have, at the end of each Fiscal Quarter set forth below, an Adjusted Leverage Ratio as of the last day of such Fiscal Quarter and for the 12-month period then ended of not more than the following:
Maximum Adjusted Leverage Ratio. The Parent will not permit the ratio (the “Adjusted Leverage Ratio”), determined on a Pro Forma Basis, of (i) Funded Indebtedness plus Additional Contingent Consideration, plus the present value of all obligations to plug and abandon oil and gas wxxxx (and modifications to structures and pipelines) as reflected on the Borrower’s financial statements in accordance with GAAP, in each case, as of the end of each fiscal quarter (the determination date) to (ii) EBITDA for the four fiscal quarters ending with such determination date, to be greater than 3.65 to 1.00.
Maximum Adjusted Leverage Ratio. Borrower shall not permit the Adjusted Leverage Ratio, determined as of the last day of any fiscal quarter of Borrower (measured on a rolling four quarter basis), to be greater than 3.00 to 1.00.
Maximum Adjusted Leverage Ratio. As of the end of any fiscal quarter, permit the Adjusted Leverage Ratio for the period of four (4) consecutive fiscal quarters ending on such date, to equal or exceed 3.50 to 1.00.”
Maximum Adjusted Leverage Ratio. Permit, as of the last day of any fiscal quarter starting with the fiscal quarter ending December 31, 2013, for the twelve-month period ending on such day, the Adjusted Leverage Ratio to exceed the Maximum Adjusted Leverage Ratio applicable as of such day in accordance with the definition thereof.
Maximum Adjusted Leverage Ratio. Suffer or permit the ratio of (A) the sum of Total Adjusted Liabilities to (B) Adjusted Tangible Net Worth to be more than 3:1 at any time.
Maximum Adjusted Leverage Ratio. The Adjusted Leverage Ratio, as of the last day of each fiscal quarter of the Parent, shall be less than or equal to 5.00 to 1.0.
Maximum Adjusted Leverage Ratio. Permit its Adjusted Leverage Ratio to exceed 2.75 to 1.00 as of the last day of any fiscal quarter for the period of four fiscal quarters ending on such date; provided, that such requirement shall be deemed to be satisfied as of any date of determination when the numerator equals zero notwithstanding whether or not the denominator is a positive number.
Maximum Adjusted Leverage Ratio. The Parent will not permit the ratio (the “Adjusted Leverage Ratio”), determined on a Pro Forma Basis, of (i) Funded Indebtedness, plus Additional Contingent Consideration, plus the present value of all obligations for platform decommissioning, wellbore plug and abandonment, and pipeline decommissioning, in each case as reflected on the Borrower’s financial statements in accordance with GAAP as of the end of each fiscal quarter (the determination date), less performance bond amounts and escrow account amounts securing decommissioning obligations as of the determination date, to (ii) EBITDA for the four fiscal quarters ending with such determination date, to be greater than 3.65 to 1.00.
