Common use of MAXIMUM  AMOUNT  OF  LIQUIDATED  DAMAGES Clause in Contracts

MAXIMUM  AMOUNT  OF  LIQUIDATED  DAMAGES. The maximum amount of liquidated damages referred to in Articles 8. (Delivery) and 13. (Performances) hereof, shall in no case whatsoever exceed ten per cent (10%) of the Ship price set forth in Articles 9., but should said amount exceed it, then the Owner waives as from now its entitlement to any higher amount: the Owner, as an alternative to receiving the above liquidated damages, shall have the option to resolve this Contract with the consequences provided for in Article 15. hereof.
