Maximum Delinquent Notes Receivable Percentage of Borrower. Permit the aggregate unpaid principal balance of all Notes Receivable that are Delinquent Notes Receivable as of the last day of any fiscal month, to be in excess of ten percent (10%) of the aggregate unpaid principal balance of all Notes Receivable as of such day.

For the avoidance of doubt, all performance metrics related to the Notes Receivables held by Hercules Funding III shall carry forward without re-set or interruption due to the ultimate re-sale of such Notes Receivables to the Borrower.
