Common use of Maximum number of Loans Clause in Contracts

Maximum number of Loans. (a) The Company may not deliver a Utilisation Request if as a result of the proposed Utilisation more than 12 Loans would be outstanding (or such greater number of Loans as may be agreed by the Agent in its sole discretion). (b) The Company may not request that a Loan be divided. (c) No Extended Loan shall be taken into account in this Clause 4.3.

Maximum number of Loans. (b) The Company may not request that a Loan be divideddivided if, as a result of the proposed division, more than five Loans would be outstanding. (c) No Extended Any Loan made by a single Lender under Clause 6.2 (Unavailability of a currency) shall not be taken into account in this Clause 4.34.4.
