Common use of MEDIATION FEES, EXPENSES AND COSTS Clause in Contracts

MEDIATION FEES, EXPENSES AND COSTS. 5.1. The Mediator’s fees and any other expenses associated with the mediation will be shared equally between the parties unless agreed otherwise. Payment of these fees and expenses will be made to SMG Mediation Ltd in accordance with SMG Mediation’s terms and conditions of business. 5.2. Each Party will pay its own costs and expenses in instructing any legal representative to prepare for, and/or participate in the mediation. Unless agreed otherwise, these costs will be costs in the cause.
