Common use of Member Hold Harmless Clause in Contracts

Member Hold Harmless. Notwithstanding any provision in this Agreement to the contrary, Health Plan shall prohibit providers, under any circumstance including but not limited to non-payment by Health Plan or SDOH, insolvency of Health Plan or breach of Health Plan’s agreement with a provider, from billing, charging, collecting a deposit from, seeking compensation or remuneration from or having any recourse against any Member for fees that are the responsibility of Health Plan or SDOH.
