Common use of Merger or Consolidation of Bank Clause in Contracts

Merger or Consolidation of Bank. Any corporation or association (i) into which the Bank may be merged or with which it may be consolidated, (ii) resulting from any merger, consolidation, or reorganization to which the Bank may be a party, or (iii) to which all or substantially all of the fiduciary business of the Bank may be transferred shall become a Successor Custodian under this Agreement without the necessity of executing any instrument or performing any further act subject to the provision of this Agreement concerning resignation or removal of the Custodian.
