Common use of Merger or Consolidation of SSB Clause in Contracts

Merger or Consolidation of SSB. Any corporation into which SSB in its individual capacity may be merged or with which it may be consolidated, or any corporation resulting from any merger or consolidation to which SSB shall be a party, or any corporation to which substantially all the business of the Owner Trustee in its individual capacity may be transferred, shall, subject to Section 11.01 of the Participation Agreement, be the Owner Trustee under this Agreement without further act; provided, that such corporation shall not also be the Indenture Trustee.
