MEZZANINE REPRESENTATIONS. Not withstanding the provisions of Sections 4.1 to 4.37, inclusive, with regard to any portion of the Loan advanced by Lender as a Mezzanine Loan, the "Representations and Warranties" contained in Article 3 of the Mezzanine Loan Agreement shall be applicable to the Individual Borrower.
