Common use of Miami, FL; Orlando, FL; Ft Clause in Contracts

Miami, FL; Orlando, FL; Ft. Lauderdale, FL; Charlotte-Gastonia-Rock Hill, NC; Greensboro-Winston Salem- High Point, NC; Nashville, TN; and New Orleans, LA; or (2) serves an End User with a DS1 or higher capacity Loop in any service area covered by this Agreement. To the extent that Newcomm is serving any End User as described in (2) above as of the Effective Date of this Agreement, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm or transitioned by Newcomm, pursuant to Section 1.8 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.8.

To the extent that Newcomm Hotline is serving any End User as described in (2) above as of the Effective Date of this Agreement, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm Hotline or transitioned by NewcommHotline, pursuant to Section 1.8 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.8.

To the extent that Newcomm Ring Connection is serving any End User as described in (2) above as of the Effective Date of this Agreement, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm Ring Connection or transitioned by NewcommRing Connection, pursuant to Section 1.8 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.8.

To the extent that Newcomm US LEC is serving any End User as described in (2) above as of the Effective Date of this Agreementhereof, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm US LEC or transitioned by NewcommUS LEC, pursuant to Section 1.8 1.7 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.81.7.

To the extent that Newcomm US LEC is serving any End User as described in (2) above as of the Effective Date of this Agreementhereof, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm US LEC or transitioned by NewcommUS LEC, pursuant to Section 1.8 1.7 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.81.7.

To the extent that Newcomm JCM is serving any End User as described in (2) above as of the Effective Date of this Agreement, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm JCM or transitioned by NewcommJCM, pursuant to Section 1.8 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.8.

To the extent that Newcomm Southern Telecom is serving any End User as described in (2) above as of the Effective Date of this Agreement, such End User’s arrangement may not remain in place and such Arrangement must be terminated by Newcomm Southern Telecom or transitioned by NewcommSouthern Telecom, pursuant to Section 1.8 of this Attachment or BellSouth shall disconnect such Arrangements pursuant to Section 1.8.
