Microwave Transport Clause Samples

Microwave Transport. Nothing in this Section precludes the ability of Pathnet to request microwave transport with its physical collocation except where not practical for technical reasons or space limitations. 2.7.1. A Bona Fide Request (BFR) shall be submitted in writing by Pathnet and shall specifically include technical requirements, space requirements and/or other such specifications that clearly define the request such that GTE has sufficient information to analyze and prepare a response. 2.7.2. Pathnet may cancel a BFR in writing at anytime prior to Pathnet and GTE agreeing to price and availability. If Pathnet cancels the BFR, then GTE will then cease analysis of the request. 2.7.3. Within five (5) Business Days of its receipt, GTE shall acknowledge in writing the receipt of the BFR and identify a single point of contact and any additional information needed to process the request. 2.7.4. Except under extraordinary circumstances, within thirty (30) Business Days of receipt of a BFR, GTE shall provide a proposed price and availability date, or it will provide an explanation as to why GTE elects not to meet Pathnet's request. If extraordinary circumstances prevail, GTE will inform Pathnet as soon as it realizes that it cannot meet the thirty (30) Business Day response due date. Pathnet and GTE will then determine a mutually agreeable date for receipt of the response. 2.7.5. Upon affirmative response from GTE, Pathnet will submit in writing its acceptance or rejection of GTE's proposal. If at any time an agreement cannot be reached as to the terms and conditions or price of the request, the Parties agree to follow the Alternative Dispute Resolution procedures described in the General Terms of the, Agreement, Section 14. Any rejection should only be based on technical reasons or space limitations, including future building plans within the next planning cycle of 2 years, or other structural issues. 2.7.6. Within ten (10)Business Days of receipt of Pathnet's acceptance of the proposal, GTE will schedule an on site meeting with Pathnet to discuss the requirements of the BFR and establish timelines for the project.
