Minimum Annual Steam Usage. Buyer shall, beginning on the date of Commercial Operation and in each Year thereafter during the Term, and in the partial Year with which the Term ends, accept and utilize in its thermal industrial processes, when Tendered, an amount of Cogenerated Steam sufficient to preserve the Facility's status as a qualifying cogeneration facility under applicable state and federal laws and regulations in effect at the time of execution of this Agreement, including but not limited to, the Fuel Use Act of 1978 ("FUA") and the Public Utility Regulatory Policies Act of 1978 ("PURPA"). The foregoing obligation shall be satisfied, if during each such Year or partial Year, Buyer accepts and so utilizes, when Tendered, a quantity of Cogenerated Steam sufficient to average at least 23,000 pounds per hour of operation of the Facility. Buyer shall use reasonable efforts to accept and so utilize such greater amounts of Cogenerated Steam as may be necessary to maintain such qualification in the event such laws or regulations are amended so as to require greater utilization.
