Minimum Basic Rent Clause Samples

Minimum Basic Rent. Notwithstanding any other provisions of the Operative Agreements to the contrary, each installment of Basic Rent due on each Rent Payment Date and not constituting an Excepted Payment shall be, under any and all circumstances, an amount at least sufficient to pay in full any installment of principal of and interest on the Certificates required to be paid pursuant to the Certificates (other than amounts becoming due on account of the exercise of remedies pursuant to Article 17 hereof) on such Rent Payment Date. Notwithstanding any other provisions of the Operative Agreements to the contrary, the EBO Amount on the Rent Payment Date when payable, shall be, under any and all circumstances, except in connection with the assumption by the Lessee of the Certificates pursuant to Section 7.11 of the Participation Agreement, in an amount not less than an amount sufficient to pay in full as of such date the aggregate outstanding principal amount of the Certificates plus the accrued and unpaid interest thereon to such date of payment.

Minimum Basic Rent. Notwithstanding any other provision of this Lease to the contrary, each installment of Basic Rent due on each Rent Payment Date and not constituting an Excepted Payment shall be, under any and all circumstances, an amount at least sufficient to pay in full each installment of principal of and interest on the Loan Certificates (assuming the full drawdown thereof) then required to be paid pursuant to the Loan Certificates (other than, during the Accretion Loan Availability Period, the Accretion Amount with respect to such Rent Payment Date and amounts becoming due in connection with the exercise of remedies pursuant to Section 15 hereof).
