Common use of Minimum/Maximum/Additional Space Clause in Contracts

Minimum/Maximum/Additional Space. The minimum amount of floor space available to Pathnet at the time of the initial application will be twenty-five (25) square feet of caged collocation space or one (1) single bay in the case of cageless collocation. The maximum amount of space available in a specific wire center or access tandem to Pathnet will be limited to the amount of existing suitable space which is technically feasible to support the collocation arrangement requested. Existing suitable space is defined as available space in a wire center or access tandem which does not require the addition of AC/DC power, heat and air conditioning, battery and/or generator back-up power and other requirements necessary for provisioning collocation services. Additional space to provide for caged, cageless and/or adjacent collocation will be provided on a per request basis, where available. Additional space can be requested by Pathnet by completing and submitting a new application form and the applicable non-refundable engineering fee set forth in Appendix G described in Section 6.1. GTE will not be required to lease additional space when available space has been exhausted.
