Common use of MIS – DECLARATION OF AVAILABILITY Clause in Contracts

MIS – DECLARATION OF AVAILABILITY. In the case of mis-declaration of Available Capacity, the Company shall be liable to pay Liquidated Damages for double of the difference between declared availability and the actual availability for the entire period with effect from the time of declaration of the present availability at the rate as mentioned in the Section 6.2 of this Agreement.
