Miscellaneous Policy Provisions. All insurance policies providing builder’s risk, builder’s risk delayed startup, marine cargo or marine cargo delayed startup (i) shall not include any annual or term aggregate limits of liability except for the perils of flood, windstorm, and strikes, riots and civil commotion, (ii) shall have any aggregate limits of liability apply separately with respect to the Project, (iii) shall have aggregate limits for flood, earth movement and windstorm that apply annually and (iv) if commercially feasible, shall not include a clause requiring the payment of additional premium to reinstate the limits after loss except for insurance covering the perils of flood, earth movement and windstorm.
Miscellaneous Policy Provisions. All insurance policies providing operational property damage, (i) shall name the Collateral Agent, on behalf of the Secured Parties, as the first loss payee, (ii) shall include a Lender’s loss payable clause in favor of the Collateral Agent, on behalf of the Secured Parties.
Miscellaneous Policy Provisions. All policies of insurance required to be maintained pursuant to Sections (B)(9), (10), (11), (12), (13) and (14) shall (i) not include any annual or term aggregate limits of liability or clause requiring the payment of additional premium to reinstate the limits after loss except as regards the insurance applicable to the perils of flood, earth movement, sabotage and terrorism, (ii) shall include OPIC as additional insured as its interest may appear and (iii) include a clause requiring the insurer to make final payment on any claim within thirty (30) days after the submission of proof of loss and its acceptance by the insurer.

The marine cargo, property damage (including machinery) insurance policies effected pursuant to this Section 5.9 shall not include any annual or term aggregate limits of liability or clause requiring the payment of an additional premium to reinstate the limits after loss except as regards the insurance applicable to the perils of flood, earth movement, sabotage and terrorism.

All policies of insurance required to be maintained pursuant to Part B and Part C, shall (i) not include any annual or term aggregate limits of liability except as regards the insurance applicable to the perils of flood and earth movement and pollutant clean up of land and water at the Site, (ii) shall include the Lessor and the Participants as additional insureds and the Administrative Agent as sole loss payee, and (iii) include a clause requiring the insurer to make final payment on any claim within 30 days after the submission of proof of loss and its acceptance by the insurer.

All insurance policies providing builder’s risk, construction all risk, operational property damage, delayed startup, marine cargo, marine cargo delayed startup, terrorism or business interruption, (a) shall not include any annual or term aggregate limits of liability except for the perils of flood, windstorm, earth movement and terrorism, (b) shall have any aggregate limits of liability apply separately with respect to the Project, (c) shall not include a clause requiring the payment of additional premium to reinstate the limits after loss except for insurance covering the perils of flood, windstorm, earth movement and terrorism, (d) shall include the Lenders as additional insureds as their interest may appear, and (e) shall include a clause requiring the insurer to pay losses within 30 days after receipt of an acceptable proof of loss or partial proof of loss.
