Common use of Misfit of Materials Clause in Contracts

Misfit of Materials. Contractor shall notify Owner of any lack of, or requirement for, materials and equipment required under the Contract to be supplied by Owner (if any) in sufficient time for Owner to furnish said materials or equipment in advance of Contractor's need. In the event of a misfit of Owner furnished materials or equipment, Contractor shall promptly notify Owner or Owner’s Representative of such misfit. Contractor shall take all reasonable steps to avoid standby time due to such misfit or lack of Owner furnished materials or equipment and to continue progress of other portions of the Work pending correction of such misfit and/or the furnishing of materials or equipment.
