Common use of Missing or Insufficient Review Materials Clause in Contracts

Missing or Insufficient Review Materials. If any of the Review Materials are missing or insufficient for the Asset Representations Reviewer to perform any Test, the Asset Representations Reviewer will notify the Servicer promptly, and in any event no less than 20 days before completing the Review, and the Servicer will have 15 days to provide the Asset Representations Reviewer access to such missing Review Materials or other documents or information to correct the insufficiency. If the missing or insufficient Review Materials have not been provided by the Servicer within 15 days, the parties agree that the Subject Receivable will have a Test Fail for the related Test(s) and the Test(s) will be considered a Test Complete and the Review Report will indicate the reason for the Test Fail.

If the missing or insufficient Review Materials have not been provided by the Servicer within 15 [15] days, the parties agree that the Subject Review Receivable or Review Account, as applicable, will have a “Test Fail Incomplete” for the related Test(s) and the Test(s) will be considered a Test Complete and the Review Report will indicate the reason for the Test FailIncomplete.
