Common use of Mistake in Debit Clause in Contracts

Mistake in Debit. Tenant agrees that it shall remain responsible to Landlord for all payments of Rent, late fees and other charges pursuant to the Lease, even if Tenant’s bank account is incorrectly debited in any given month. If an error in the debit is made in the favor of Tenant, Tenant shall correct the underpayment within three (3) business days after receipt of notice from Landlord. If an error in the debit is made in favor of Landlord, Landlord shall refund the overpayment within the earlier of three (3) business days after Landlord’s discovery of the error or three (3) business days after receipt of notice from Tenant.
