Common use of Misuse of Marks Clause in Contracts

Misuse of Marks. Each party understands and agrees that any --------------- use of the other party's marks, other than as expressly authorized by this Agreement, without the other party's prior written consent, is an infringement of such other party's rights in and to its marks and that the right granted herein to use the other party's marks does not extend beyond the termination or expiration of this Agreement. Each party expressly covenants that, during the term of this Agreement and thereafter, such party shall not, directly or indirectly, commit any act of infringement or contest or aid others in contesting the validity of such other party's right to use its marks or take any other action in derogation thereof.
