Mitigation and Exclusivity. Nothing contained in this Agreement shall affect the obligation of a party seeking indemnification to take commercially reasonable steps to mitigate its losses. The provision of this Article 6 shall apply to any Claim for breach of any covenant, representation, warranty or other provision of this Agreement or any agreement, certificate or other document delivered pursuant hereto (other than a claim for specific performance or injunctive relief) with the intent that all such Claims shall be subject to the limitations and other provisions contained in this Article 6.
