Common use of Mitigation of Adverse Circumstances Clause in Contracts

Mitigation of Adverse Circumstances. If, in respect of any Lender, circumstances arise which would, or would upon the giving of notice, result in additional amounts becoming payable under clause 10 or clause 11.1 or result in a cancellation of its Commitment pursuant to clause 12.1.1 then, without in any way limiting, reducing or otherwise qualifying the obligations of any Borrower hereunder such Lender will, at the request of Ideal, consider means of mitigating the effects of such circumstances provided that such Lender shall be under no obligation to take any such action if to do so would or might in its opinion have an adverse effect on its business, operations or financial condition.
