Common use of Mitigation of Damages Clause in Contracts

Mitigation of Damages. Executive is not required to mitigate the amount of any payments to be made by the Company pursuant to this Agreement following his termination by seeking other employment or otherwise. In addition, the amount of any post-termination payments provided for in this Agreement shall, except as otherwise expressly provided herein, not be reduced by any remuneration earned by Executive during the period following the termination of his employment as a result of employment by another employer or otherwise after the date of termination of his employment with the Company.

In addition, the amount of any post-termination payments provided for in this Agreement shall, except as otherwise expressly provided herein, not be reduced by any remuneration earned by Executive during the period following after the termination of his employment hereunder, and no amounts earned by Executive, whether from self-employment, as a result common-law employee or otherwise, shall reduce the amount of employment by another employer or any termination amount otherwise after the date of termination of his employment with the Companypayable to him.
