Common use of Mitigation of Harm Clause in Contracts

Mitigation of Harm. Business Associate agrees to mitigate, to the extent practicable, any harmful effect that is known to Business Associate of a use or disclosure of PHI by Business Associate in violation of the requirements of this Agreement or the Privacy Rule or Security Rule.

Mitigation of Harm. Business Associate agrees to shall mitigate, to the extent practicablepractical, any harmful effect that is known to Business Associate of a use or and/or disclosure of PHI by the Business Associate Associate, and any of its agents or subcontractors, in violation of the requirements of this Agreement or the Privacy Rule or Security RuleAgreement.

Business Associate agrees shall, at its own expense, take action to mitigate, to the extent practicable, any harmful effect that is known to Business Associate of a use or disclosure of PHI by Business Associate Associate, or any agent or subcontractor of Business Associate, in violation of the requirements of the HIPAA Rules or this Agreement or the Privacy Rule or Security RuleAgreement.

Mitigation of Harm. Business Associate agrees to mitigate, to the extent practicable, mitigate any harmful effect that is known to Business Associate of a an access, use or disclosure of PHI by Business Associate in violation of the requirements of this Agreement Agreement, the Services Agreement, HIPAA or the Privacy Rule or Security RuleHIPAA Rules.
