MOD ADDITIONAL CLAUSES. The definition of Call Off Contract in Call Off Schedule 1 (Definitions) to the Call Off Terms shall be replaced with the following: Call Off Contract means this written agreement between the Customer and the Supplier consisting of the Order Form and the Call Off Terms and the MoD Terms and Conditions. The following definitions shall be inserted into in Call Off Schedule 1 (Definitions) to the Call Off Terms: MoD Terms and Conditions means the contractual terms and conditions listed in Schedule […] which form part of the Call Off Terms [Guidance Note: read with the Guidance Note below] Site shall include any of Her Majesty's Ships or Vessels and Service Stations. Officer in charge shall include Officers Commanding Service Stations, Ships' Masters or Senior Officers, and Officers superintending Government Establishments. The following clauses shall be inserted into Clause 2 of this Call Off Contract (Due Diligence): The Supplier confirms that it has had the opportunity to review the MoD Terms and Conditions and has raised all due diligence questions in relation to those documents with the Customer prior to the Commencement Date. Where required by the Customer, the Supplier shall take such actions as are necessary to ensure that the MoD Terms and Conditions constitute legal, valid, binding and enforceable obligations on the Supplier. The following new Clause [59] shall apply:
