Moderate Intellectual Disability Payment. Subject to this Agreement and in accordance with this clause and any Guidelines, the Department will pay the Provider a Moderate Intellectual Disability Payment in relation to each Moderate Intellectual Disability Participant. Moderate Intellectual Disability Payment is payable by the Department: in the amount specified in Annexure B, as applicable to the Moderate Intellectual Disability Participant; for: up to four Four-week Outcomes during the Period of Service, where the Moderate Intellectual Disability Participant works a minimum of 45 hours of paid Employment, over a Four-week Period for that Moderate Intellectual Disability Participant; and a Full Outcome, where, for the duration of a 13-week Period or a 26-week Period, or 52-week Period the Moderate Intellectual Disability Participant works a minimum of 195 hours in 13 Consecutive Weeks (for the 13-week Period) or 390 hours in 26 Consecutive Weeks (for the 26-week Period or 52-week Period); and where, in each instance, the Moderate Intellectual Disability Participant also meets the requirements for payment of an Outcome Fee under the definition of a Four-week Outcome or under paragraph (b)(i), (ii) or (iii) of the definition of Full Outcome, in accordance with clause 146.7 [Outcome Fees], respectively. The Provider must submit a claim for payment of a Moderate Intellectual Disability Payment in accordance with any Guidelines. Section 5O Gap Filling Gap filling If the Department identifies a gap in the provision of Program Services during the Agreement Term, the Department may, with the agreement of the Provider, require the Provider to provide additional Program Services, on the same terms as specified in this Agreement at the times requested by the Department. The Department may, without limitation, require the Provider to fill a gap in the provision of Program Services by: delivering Services in a particular ESA; delivering Services in one or more ESAs through modified service delivery modes; delivering Services in one or more ESA(s) as a condition of delivering Services in another ESA or ESAs; or expanding their delivery locations in order to provide greater coverage within an ESA. Any changes to this Agreement (including the Schedule) for the purpose of this clause 153 will be given effect in accordance with clause 73.1.
