Common use of MODIFICATION ACTIONS Clause in Contracts

MODIFICATION ACTIONS. Upon commencement of the Modification Period: (i) Executive shall immediately resign as an officer and/or director of ABM and of any ABM subsidiaries, as applicable, (ii) Executive shall promptly return all Company property in Executive’s possession to Company, including but not limited to any motor vehicles, equipment, supplies and documents set forth in Paragraph 11 of this Agreement, and (iii) ABM shall pay Executive when due any and all previously earned, but as yet unpaid, salary, Bonus pursuant to Paragraph 7B(iii), or other contingent compensation, reimbursement of business expenses and fringe benefits.

Upon commencement of the Modification Period: : (ia) Executive shall immediately resign as a full-time employee of Company and as an officer and/or director of ABM Company and of any ABM Company subsidiaries, as applicable, (iib) Executive shall promptly return all Company property in Executive’s 's possession to Company, including but not limited to any motor vehicles, equipment, supplies and documents set forth in Paragraph 11 of this AgreementJ hereof, and (iiic) ABM Company shall pay Executive when due any and all all, previously earned, earned but as yet unpaid, salary, Bonus bonus pursuant to Paragraph 7B(iii), X.2.c or other contingent compensation, reimbursement of business expenses and fringe benefits.
