Common use of Modifications of Agreements Clause in Contracts

Modifications of Agreements. Borrower shall not make, or agree to make, any modification, amendment or waiver of any of the terms or provisions of any Purchase and Sale Agreement or the Charge-Off Policy without the prior written consent of Agent. Borrower hereby represents and warrants that, as of the date hereof, it is the sole “Purchaser” (as defined in each Purchase and Sale Agreement) under each Purchase and Sale Agreement.
