Modifications of Software. AnyLogic expressly reserves the right to make additions, deletions, and/or revisions (“Updates”) to the Software and change the terms of this licensing agreement accordingly. Except as otherwise specified by AnyLogic, AnyLogic will make any Updates to the Software available to Licensees who have active Maintenance & Support services (as described in Section 7) when they become commercially available and subject to any new licensing terms. 3. CUSTOMER RESPONSIBILITIES. Customer is responsible for isolating the problem, for eliminating other factors as potential causes of the problem and for providing sufficient information, data and test cases to allow Selectica to readily reproduce all reported Errors. If Selectica believes that a problem reported by Customer may not be due to an Error in Software, Selectica will so notify Customer.

Modifications of Software. Company shall inform HMS in writing of any modifications made to the Software. HMS shall not be responsible for maintaining Company's modified portions of the Software. Corrections for difficulties or defects traceable to Company's errors or system changes will be billed at HMS's standard time and materials rates then in effect.
