Modifications to the Services. In the event that the ETF or the Adviser desire to implement any changes related to the Services set forth herein (including, without limitation, changes to fees, CUSIPs, fund names, order cut-off times, and affirmation/confirmation disclosure), the Adviser shall provide written notice of said requested changes to SIDCO at least two weeks prior to the proposed effectiveness of said change to enable SIDCO to evaluate the impact that said change shall have on SIDCO’s operating procedures, if any. SIDCO shall have no obligation to implement any requested changes to the Services unless said changes specifically are agreed in writing. In the event that XXXXX agrees to implement the proposed changes, SIDCO promptly shall notify the Adviser of any corresponding changes to the Services or fees set forth in this Agreement, and, if the proposed changes require modification of SIDCO’s operating procedures, SIDCO shall notify Adviser of said changes to SIDCO’s operating procedures.
Modifications to the Services. 13.1 The Company’s Representative shall have the power to issue to the Supplier instructions in writing:
13.1.1 requiring the Supplier to vary the scope of the Services or any part thereof;
13.1.2 requiring the Supplier to omit or postpone the performance of any part or the whole of the Services;
13.1.3 requiring the Supplier to vary any instructions or any part thereof issued by the Company’s Representative.
13.2 The valuation of modifications to Services requested pursuant to this Condition 13 shall be ascertained by the Company’s Representatives in accordance with Condition 10.
13.3 Where the modification involves an omission, reduction or postponement the valuation shall not include and the Company shall not be liable to the Supplier in respect of, any loss or reduced contribution to overheads or profit whether in respect of this Agreement or any lost opportunity to earn overhead contribution or profit elsewhere.
Modifications to the Services. Provider may update the Services from time to time. If Provider changes the Services in a manner that materially reduces their functionality, Provider will inform Customer via the email address associated with the account.
Modifications to the Services. Host Compliance may update the Services from time to time. If Host Compliance updates the Services in a manner that materially improves functionality, Host Compliance will inform the Customer.
Modifications to the Services. Think Power may update the Services from time to time. If Think Power changes the Services in a manner that materially reduces their functionality, Think Power will inform Customer via the email address associated with the account.
Modifications to the Services. We may make modifications to the Services or particular components of the Services from time to time provided that such modifications do not materially degrade any functionality or features of the Services.
Modifications to the Services. 8bits1byte Limited may update the Services from time to time. If 8bits1byte Limited changes the Services in a manner that materially reduces their functionality, 8bits1byte Limited will inform Customer via the email address associated with the account.
Modifications to the Services. DR reserves the right at any time and for any reason to modify, or temporarily or permanently discontinue, the Services or any portion thereof, with or without notice. You agree that DR shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.
Modifications to the Services. Xxxxx Server reserves the right to update the Services at any time, or add or subtract features from the Services at any time; provided, however, that if Xxxxx Server makes any modifications to the Services which will materially affect Customer’s ability to use the Services, Xxxxx Server will provide notification of such changes by sending notice to the email address associated with Customer’s Account.
Modifications to the Services a. SIB reserves the right, but shall not be obliged, to make changes, enhancements, and/or modifications to the Services offered by SIB from time to time including, without limitation, the development of updates, patches, upgrades and/or the procurement of new releases of any software or the Internet Payment Gateway or any changes in Payment Mechanism.
b. SIB shall be entitled to use hardware, software and/or such other equipment as it deems necessary or appropriate for the provision of the Services and the Merchant agrees to comply with the directions and/or instructions issued by SIB in respect of the use of such hardware, software and/or equipment. The Merchant also agrees to suitably modify/upgrade its systems to comply with the standards of the Payment Mechanisms (then in force) and the standards applicable to the various services provided by SIB. SIB may accordingly modify the Payment Mechanism in such manner as may be deemed fit by SIB.
c. If a change in the Payment Mechanism involves:
i. Any change in this Agreement, then the Merchant shall execute such additional agreements, writings, documents as may be required from time to time;
ii. Any change in the software, upgradation of software, change in security or upgradation of security on the Merchant Site, the Merchant shall, at its own costs, forthwith improve the software, security or such other matters provided therein in a manner acceptable to SIB.
