Common use of Modified and New Products Clause in Contracts

Modified and New Products. Distributor shall provide timely comprehensive information to its Customers with respect to newly available Products, discontinuance of Products and changes in existing Products, including, but not limited to, performance specification changes.

Distributor shall timely provide timely comprehensive information to its Customers with respect to newly available Products, discontinuance of Products and changes in existing Products, including, but not limited to, performance specification changeschanges and required software upgrades in Analyzers (which may or may not be coupled to specific lots of Cartridges). Distributor shall use commercially reasonable efforts to ensure that each Customer in the Territory makes any such performance specification changes and software upgrades in a timely manner.
