Common use of MONTHLY BASE RENTAL Clause in Contracts

MONTHLY BASE RENTAL. A. In addition to Tenant's obligation to pay Base Rental for the Original Premises, Tenant shall pay Landlord Base Rental with respect to the First Additional Expansion Space in monthly installments as follows: (i) Equal installments of [***] each payable on or before the first day of each month during the period beginning on the First Additional Expansion Effective Date and ending December 31, 2007. (ii) Sixty (60) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2008 and ending December 31, 2012. (iii) Seventeen (17) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2013 and ending May 31, 2014. B. In addition to Tenant's obligation to pay Base Rental for the Original Premises, Tenant shall pay Landlord Base Rental with respect to the Second Additional Expansion Space in monthly installments as follows: (i) Equal installments of [***] each payable on or before the first day of each month during the period beginning on the Second Additional Expansion Effective Date and ending December 31, 2007. (ii) Sixty (60) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2008 and ending December 31, 2012. (iii) Seventeen (17) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2013 and ending May 31, 2014. All such Base Rental shall be payable by Tenant in accordance with the terms of Article 6 of the Lease.

In addition to Tenant's obligation to pay Base Rental for the Original PremisesPremises (other than the Fourth Early Initial Expansion Space), Tenant shall pay Landlord Base Rental with respect to the First Additional Fourth Early Initial Expansion Space (which shall be in lieu of the Base Rental set forth in the Lease with respect to the Fourth Early Initial Expansion Space) in monthly installments as follows: (i) Equal installments of [***] each payable on or before the first day of each month during the period beginning on the First Additional Fourth Early Expansion Effective Date and ending December 31, 2007. (ii) Sixty (60) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2008 and ending December 31, 2012. (iii) Seventeen (17) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2013 and ending May 31, 2014. B. In addition to Tenant's obligation to pay Base Rental for the Original PremisesPremises (other than the Fifth Early Initial Expansion Space), Tenant shall pay Landlord Base Rental with respect to the Second Additional Fifth Early Initial Expansion Space (which shall be in lieu of the Base Rental set forth in the Lease with respect to the Fifth Early Initial Expansion Space) in monthly installments as follows: (i) Equal installments of [***] each payable on or before the first day of each month during the period beginning on the Second Additional Fifth Early Expansion Effective Date and ending December 31, 2007. (ii) Sixty (60) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2008 and ending December 31, 2012. (iii) Seventeen (17) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2013 and ending May 31, 2014. All such Base Rental shall be payable by Tenant in accordance with the terms of Article 6 of the Lease.

In addition to Tenant's obligation to pay Base Rental for the Original PremisesPremises (other than the First Early Initial Expansion Space), Tenant shall pay Landlord Base Rental with respect to the First Additional Early Initial Expansion Space (which shall be in lieu of the Base Rental set forth in the Lease with respect to the First Early Initial Expansion Space) in monthly installments as follows: (i) Equal installments of [***] each payable on or before the first day of each month during the period beginning on the First Additional Expansion Effective Date and ending December 31, 2007. Twelve (ii) Sixty (6012) equal installments of [***] each payable on or before the first day of each month during the period beginning January October 1, 2008 2001 and ending December 31September 30, 20122002. (iiiii) Seventeen One Hundred Forty (17140) equal installments of [***] each payable on or before the first day of each month during the period beginning January October 1, 2013 2002 and ending May 31, 2014. B. In addition to Tenant's obligation to pay Base Rental for the Original PremisesPremises (other than the Second Early Initial Expansion Space), Tenant shall pay Landlord Base Rental with respect to the Second Additional Early Initial Expansion Space (which shall be in lieu of the Base Rental set forth in the Lease with respect to the Second Early Initial Expansion Space) in monthly installments as follows: (i) Equal Eleven (11) equal installments of [***] each payable on or before the first (1st) day of each month during the period beginning on November 1, 2001 and ending September 30, 2002; provided, however, that, so long as Tenant is not then in default under the terms and provisions of the Lease, Tenant shall have the right to defer payment of Base Rental and Tenant's Estimated Operating Expense Contribution solely with respect to the Second Additional Early Initial Expansion Effective Date Space for the months of November 2001 and ending December 312001 until January 1, 20072002 (i.e. Tenant may pay Base Rental and Tenant's Estimated Operating Expense Contribution with respect to the Second Early Initial Expansion Space for the months of November 2001 and December 2001 at the same time that it pays the same for the month of January 2002). (ii) Sixty One Hundred Forty (60140) equal installments of [***] each payable on or before the first day of each month during the period beginning January October 1, 2008 and ending December 31, 2012. (iii) Seventeen (17) equal installments of [***] each payable on or before the first day of each month during the period beginning January 1, 2013 2002 and ending May 31, 2014. All such Base Rental shall be payable by Tenant in accordance with the terms of Article 6 of the Lease.
