Common use of Monthly Delivery Schedule Clause in Contracts

Monthly Delivery Schedule. Prior to the 20th of every month, the Parties shall consult regarding the production and delivery schedule for the next following month and DCRC shall provide MSCG with a report reflecting such forecasted schedule (the “Monthly Delivery Schedule”), substantially in the form attached hereto in Schedule 3, that indicates (i) the Refinery’s non-binding estimate of the production of each grade of Intermediate Product, Light Finished Product and Slurry and (ii) the Refinery’s non-binding estimate of Intermediate Products (by grade) requirements, in each case, specifying volumes of each grade of Product for delivery during the following month (each, a “Delivery Month”). DCRC shall notify MSCG promptly upon becoming aware of significant changes for operational purposes to the Monthly Delivery Schedule and MSCG shall notify DCRC promptly upon becoming aware of circumstances that could impact its ability to receive or deliver Product during the period covered by the Monthly Delivery Schedule.
