Common use of Monthly Parking Rental Clause in Contracts

Monthly Parking Rental. Tenant shall pay to Landlord, as monthly rent for the parking spaces leased by Tenant hereunder, a "MONTHLY PARKING RENTAL" per space, which shall be the "PREVAILING PARKING RENTAL" for such parking spaces in effect from time to time. The Prevailing Parking Rental shall be determined by Landlord, based on the monthly rental charged by Landlord from time to time for spaces in the Parking Facility, the unassigned or reserved nature of such parking spaces, and the fair market rental charged for comparable parking facilities in comparable buildings in the vicinity of the Property, provided that Landlord shall not increase the Monthly Parking Rental prior to the first anniversary of the Commencement Date. Tenant's Monthly Parking Rental shall be paid on the first day of each month during the Term of this Lease; provided, however, that in the event Tenant fails to pay Tenant's Monthly Parking Rental when due, Landlord may assess a late charge of $150 on the delinquent amount, which late charge shall be in addition to the late charge and interest that may be charged pursuant to Section 16.1 - Late Charge and Interest in the Lease, and provided further that in the event Tenant fails to pay Tenant's Monthly Parking Rental within forty-five (45) days of Landlord's notice of such delinquency, Landlord shall have the right by notice to Tenant permanently to terminate Tenant's rights to use parking spaces hereunder, whether or not Landlord declares a default under the Lease.

The Prevailing Parking Rental shall be determined by Landlord, based on the monthly rental charged by Landlord from time to time for spaces in the Parking Facility, the unassigned or reserved nature of such parking spaces, and the fair market rental charged for comparable parking facilities in comparable buildings in the vicinity of the Property, provided that Landlord shall not increase the Monthly Parking Rental prior to the first anniversary of the Commencement Date. Tenant's Monthly Parking Rental shall be paid on the first day of each month during the Term of this Lease; provided, however, that in the event Tenant fails to pay Tenant's Monthly Parking Rental when due, Landlord may assess a late charge of $150 40.00 on the delinquent amount, which late charge shall be in addition to the late charge and interest that may be charged pursuant to Section 16.1 - Late Charge and Interest in the Lease, and provided further that in the event Tenant fails to pay Tenant's Monthly Parking Rental within forty-five thirty (4530) days of Landlord's notice of such delinquency, Landlord shall have the right by notice to Tenant permanently to terminate Tenant's rights to use parking spaces hereunder, whether or not Landlord declares a default under the Lease.

Tenant's Monthly Parking Rental shall be paid on the first day of each month during the Term of this Lease; provided, however, that in the event Tenant fails to pay Tenant's Monthly Parking Rental when due, Landlord may assess a late charge of $150 50.00 on the delinquent amount, which late charge shall be in addition to the late charge and interest that may be charged pursuant to Section 16.1 - Late Charge and Interest in the Lease, and provided further that in the event event: (i) Tenant fails to pay Tenant's Monthly Parking Rental within forty-five thirty (4530) days of Landlord's notice of such delinquency, or (ii) Tenant does not use any parking spaces for a period of more than sixty (60) days, Landlord shall have the right by notice to Tenant permanently to terminate Tenant's rights to use parking spaces hereunder, whether or not Landlord declares a default under the Lease.

The Prevailing Parking Rental shall be determined by Landlord, based on the monthly rental charged by Landlord from time to time for spaces in the Parking Facilityparking garage at the Building, the unassigned or reserved nature of such parking spaces, and the fair market rental charged for comparable parking facilities in comparable buildings in the vicinity of the Property, provided that Landlord shall not increase the Monthly Parking Rental prior to the first anniversary of the Commencement DateBuilding. Tenant's ’s Monthly Parking Rental shall be paid on the first day of each month during the Term of this Lease; provided, however, that in the event Tenant fails to pay Tenant's ’s Monthly Parking Rental when due, Landlord may assess a late charge of $150 100 on the delinquent amount, which late charge shall be in addition to the late charge and interest that may be charged pursuant to Section 16.1 4.4 - Late Charge Charges and Interest in the Lease, and provided further that in the event Tenant fails to pay Tenant's ’s Monthly Parking Rental within forty-five thirty (4530) days of Landlord's ’s notice of such delinquency, Landlord shall have the right by notice to Tenant permanently to terminate Tenant's ’s rights to use parking spaces hereunder, whether or not Landlord declares a default under the Lease.
