Common use of More than One Competing Product Clause in Contracts

More than One Competing Product. If two (2) or more Competing ------------------------------- Products are sold in a country, and (i) one such Competing Product accounts for * or more of the total value of the sales (in local currency) of products in the Field in such country, and (ii) the combined sales of all Competing Products in the Field in such country exceed * of total value of the sales (in local currency) of products in the Field, then GenVec shall pay to Scios * of the amounts otherwise due pursuant to Sections 3.2 and 3.3 above with respect to sales of Licensed Products in such country.
