Common use of Mortgage and Surveys Clause in Contracts

Mortgage and Surveys. With respect to (i) each of the Xxxxxxx Property and Lucerne Property, Agent shall have received in form and substance satisfactory to Agent and the Lenders an executed Mortgage in form appropriate for recording with the appropriate Governmental Body of the jurisdiction in which each of the Xxxxxxx Property and Lucerne Property is located and (ii) each Existing Mortgaged Property, amendments to the Mortgages (each an “Existing Mortgage Amendment”) shall be delivered by Borrower for the benefit of Agent prior to the Closing Date in connection with the A&R Credit Agreement or Original Credit Agreement, as applicable, each in form appropriate for recording with the appropriate Governmental Body of the jurisdiction in which the related owned Real Property is located;

With respect to (i) each of the Xxxxxxx Andrews Property and Lucerne Property, Agent shall have received in form and substance satisfactory to Agent and the Lenders an executed Mortgage in form appropriate for recording with the appropriate Governmental Body of the jurisdiction in which each of the Xxxxxxx Andrews Property and Lucerne Property is located and (ii) each Existing Mortgaged Property, amendments to the Mortgages (each an “Existing Mortgage Amendment”) shall be delivered by Borrower for the benefit of Agent prior to the Closing Date in connection with the A&R Credit Agreement or Original Credit Agreement, as applicable, each in form appropriate for recording with the appropriate Governmental Body of the jurisdiction in which the related owned Real Property is located;
