Mortgage Taxes Clause Samples
The Mortgage Taxes clause defines the responsibility for paying taxes and assessments related to the mortgaged property. Typically, this clause requires the borrower to pay all property taxes, special assessments, and other governmental charges that could affect the lender’s security interest in the property. For example, if property taxes are not paid, the government could place a lien on the property, jeopardizing the lender’s collateral. The core function of this clause is to protect the lender by ensuring that the property remains free of tax liens and other encumbrances that could impair the value or enforceability of the mortgage.
