Common use of Mortgaged Property Undamaged; No Condemnation Proceedings Clause in Contracts

Mortgaged Property Undamaged; No Condemnation Proceedings. With respect to each Mortgage Loan, to the Servicer's knowledge, there is no proceeding pending or threatened for the total or partial condemnation of the Mortgaged Property. To the Servicer's knowledge, the related Mortgaged Property is undamaged by waste, fire, earthquake or earth movement, windstorm, flood, tornado or other casualty so as to affect adversely the value of the related Mortgaged Property as security for the Mortgage Loan or the use for which the premises were intended and each related Mortgaged Property is in good repair;

To the ServicerProvident's knowledge, the related Mortgaged Property is undamaged by waste, fire, earthquake or earth movement, windstorm, flood, tornado or other casualty so as to affect adversely the value of the related Mortgaged Property as security for the Aames Mortgage Loan or the use for which the premises were intended and each related Mortgaged Property is in good repair;

With respect to each Mortgage Loan, to the Servicer's knowledgebest knowledge of the Servicer and except as the Servicer has previously notified the Unaffiliated Seller in writing, there is no proceeding pending or threatened for the total or partial condemnation of the Mortgaged Property. To the Servicer's knowledge, the related Mortgaged Property is undamaged by waste, fire, earthquake or earth movement, windstorm, flood, tornado or other casualty so as to affect adversely the value of the related Mortgaged Property as security for the Mortgage Loan or the use for which the premises were intended and each related Mortgaged Property is in good repair;
