Mortgagee Joinder Clause Samples

Mortgagee Joinder. Each Declarant shall use its commercially reasonable efforts to seek to have any existing mortgagee of its portion of the Common Area join in this Agreement to evidence its subordination to the rights and obligations set forth herein, but such Declarant shall not be in breach of this covenant if, despite the use of such commercially reasonable efforts, such existing mortgagee does not so execute a joinder evidencing its subordination.
