Moveable Property. (a) A Foreign Guarantor shall grant security over its moveable property, subject to the general principles in these Agreed Security Principles.
(b) Until an Applicable Event has occurred and is continuing and to the extent permitted under the Notes Documents the Foreign Guarantor providing the security is permitted to dispose of and use its moveable assets.
(c) If the granting of effective security over moveable assets gives rise to registration rights or similar taxes or costs, the secured amount under such security will be proportionate to the value of the underlying moveable asset, and ‘mandates’ to grant security will be granted where customary.
Moveable Property. Subject to Section 14.2, whenever the Contractor relinquishes any part of the Contract Area, all moveable property located within the part of the Contract Area so relinquished, may be removed to any part of the Contract Area that has been retained.
Moveable Property. (a) A Foreign Note Party shall grant security over its moveable property, subject to the general principles in these Agreed Security Principles.
(b) No security over inventory needs to be granted by a Foreign Note Party if no security needs to be granted under the ABL Facility.
(c) Until an Applicable Event has occurred and is continuing and to the extent permitted under the Note Documents, the Foreign Note Party providing the security is permitted to dispose of and use its moveable assets in accordance with the terms of the Indenture.
(d) If the granting of effective security over moveable assets gives rise to registration costs or similar taxes or costs, the secured amount under such security will be proportionate to the value of the underlying moveable asset (together with such buffer as may be reasonably agreed by the Notes Collateral Agent with the Company to reflect the fluctuating nature of the asset class), and ‘mandates’ to grant security will be granted where customary.
Moveable Property. The Corporation and its Subsidiaries own, are entitled to use or hold all moveable property owned, used or held for use by them. Except as disclosed in the Disclosure Letter, neither the Corporation nor any of its Subsidiaries’ ownership of or leasehold interest in any such moveable property is subject to any Encumbrances, except for Permitted Encumbrances.

Moveable Property. Except as disclosed in the Disclosure Letter, Wedge and its Subsidiary own, are entitled to use or hold all moveable property owned, used or held for use by them. Except as disclosed in the Disclosure Letter, neither Wedge nor its Subsidiary’s ownership of or leasehold interest in any such moveable property is subject to any Encumbrances, except for Permitted Encumbrances.
Moveable Property. Subject to the Instalment Sale Agreement being entered into on or prior to the first Commencement Date, in each Relevant Country, the Equipment (other than Services) belongs to the Lessor, constitutes the Lessor's personal or moveable property (as appropriate) and in each Relevant Country no person has any rights in or to any Equipment (other than Services) by reason of that Equipment (other than Services) being, or being deemed to be, affixed to or attached to, or otherwise located on, real property.
Moveable Property. (a) The Lessor and the Lessee agrees that it is their intention that title to the Equipment (other than Services) or any part of it shall not pass to the Lessee by reason of the same being attached or affixed by any means whatsoever to, or resting by its own weight on, any land or buildings but shall remain the personal property of the Lessor. The Lessee waives any right which it may at any time have in the Equipment (other than Services) or any part of it as a result of having any interest in any such land or buildings.
(b) The Lessee shall take in each Relevant Country all such steps as the Lessor is advised by legal counsel in that Relevant Country are necessary or recommended to prevent, to the extent possible under the Applicable Law of each Relevant Country in which the Equipment (other than Services) is or is to be located, any person, including without limitation the Lessee's landlords and such landlords' mortgagees, from acquiring, having or retaining any rights in or to the Equipment (other than Services) by reason of its being affixed or attached to, or otherwise located on, real property including, without limitation, effecting any and all registrations with all Governmental Authorities it is necessary to effect in each Relevant Country in which the Equipment (other than Services) is or is to be located. In particular, but without limitation on the generality of the preceding sentence, where the Lessor has received advice from legal counsel in the Relevant Country that it is necessary or recommended so to do in order to protect the Lessor's interest in the Equipment (other than Services) the Lessee will ensure that all persons having any interest from time to time in any such land or buildings in that Relevant Country in which the Equipment (other than Services) may from time to time be installed (whether such interest arises as landlord, tenant, lessee, mortgagee or otherwise) shall prior to the installation of the Equipment (other than Services), or if later upon acquisition of such interest, receive written notice of the Lessor's ownership interest in the Equipment (other than Services) and will obtain from such persons and deliver to the Lessor written waivers in such form as the Lessor may reasonably require of any rights which they may have or acquire in the Equipment (other than Services).
Moveable Property. The machinery and equipment, rolling stock and other ----------------- tangible moveable property owned or used by the Corporation are in reasonably good operating condition, ordinary wear and tear excepted, subject to normal repairs in the ordinary course of business, and are suitable for the uses made thereof by the Corporation in the conduct of its business.
