Common use of Mutilated, Destroyed, Lost or Stolen Lessor Notes Clause in Contracts

Mutilated, Destroyed, Lost or Stolen Lessor Notes. Upon receipt by the Owner Lessor and the Indenture Trustee of evidence satisfactory to each of them of the loss, theft, destruction or mutilation of any Lessor Note and, in case of loss, theft or destruction, of indemnity satisfactory to each of them, and upon reimbursement to the Owner Lessor and the Indenture Trustee of all reasonable expenses incidental thereto and payment or reimbursement for any transfer taxes, and upon surrender and cancellation of such Lessor Note, if mutilated, the Owner Lessor will execute and the Indenture Trustee will authenticate and deliver in lieu of such Lessor Note, a new Lessor Note, dated the same date as such Lessor Note and of like tenor and principal amount. Any indemnity provided by the holder of a Lessor Note pursuant to this Section 2.9 must be sufficient in the reasonable judgment of the Owner Lessor and the Indenture Trustee to protect the Owner Lessor, the Indenture Trustee, the Paying Agent, the Registrar and any co-registrar or co-paying agent from any loss which any of them may suffer if a Lessor Note is replaced.
