Common use of Mutilated, Lost, Stolen or Destroyed Note Clause in Contracts

Mutilated, Lost, Stolen or Destroyed Note. In case this Note shall be mutilated, lost, stolen or destroyed, Maker shall issue and deliver, in exchange and substitution for and upon cancellation of the mutilated Note, or in lieu of and substitution for this Note lost, stolen or destroyed, a new Note of like tenor, but only upon receipt of evidence satisfactory to Maker of such loss, theft, or destruction of such Note.

Mutilated, Lost, Stolen or Destroyed Note. In case this Note shall be mutilated, lost, stolen or destroyed, Maker shall issue and deliver, in exchange and substitution for and upon cancellation of the mutilated Note, or in lieu of and substitution for this Note lost, stolen or destroyed, a new Note of like tenor, but only upon receipt of evidence reasonably satisfactory to Maker of such loss, theft, or destruction of such NoteNote and reasonable indemnity or bond, if requested, also reasonably satisfactory to Maker. The Holder shall pay the reasonable costs incurred by the Maker in carrying out its obligations under this Section 5.1.

In case this Note shall be mutilated, lost, stolen or destroyed, Maker Xxxxxxxx shall issue and deliver, in exchange and substitution for and upon cancellation of the mutilated Note, or in lieu of and substitution for this Note lost, stolen or destroyed, a new Note of like tenor, but only upon receipt of evidence satisfactory to Maker Borrower of such loss, theft, or destruction of such NoteNote and reasonable indemnity or bond, if requested, also satisfactory to Borrower.

In case this Note shall be mutilated, lost, stolen or destroyed, Maker Makers shall issue and deliver, deliver in exchange and substitution for and upon cancellation of the mutilated Note, or in lieu of and substitution for this Note the Note, mutilated, lost, stolen or destroyed, a new Note of like tenorin the form hereof, but only upon receipt of evidence reasonably satisfactory to Maker Makers of such loss, theft, theft or destruction of such Noteand an indemnity, if requested, also reasonably satisfactory to it.
