Common use of Mutilated or Missing Warrants Clause in Contracts

Mutilated or Missing Warrants. In case the certificate or certificates evidencing any Warrants shall be mutilated, lost, stolen or destroyed, the Company shall, at the request of the affected Warrantholder, issue and deliver in exchange and substitution for and upon cancellation of the mutilated certificate or certificates, or in lieu of and substitution for the certificate or certificates lost, stolen or destroyed, a new Warrant certificate or certificates of like tenor and representing an equivalent right or interest, but only upon receipt of evidence reasonably satisfactory to the Company of the loss, theft, destruction or mutilation of such Warrant and, if requested, at the cost and expense of the Warrantholder (in the case of loss, theft or destruction), an unsecured bond of indemnity in form and amount reasonably satisfactory to the Company. Such substitute Warrant certificate shall also comply with such other reasonable regulations as the Company may prescribe.

Such Applicants for such substitute Warrant Warrants certificate shall also comply with such other reasonable regulations and pay such other reasonable charges as the Company may prescribe.

In case any of the certificate or certificates evidencing any Warrants Warrant Certificates shall be mutilated, lost, stolen or destroyed, the Company shallCompany, at the request of the affected WarrantholderR&R or any subsequent other registered holder thereof, shall issue and deliver in exchange and substitution for and upon cancellation of the mutilated certificate or certificatesWarrant Certificate, or in lieu of and in substitution for the certificate or certificates Warrant Certificate lost, stolen or destroyed, a new Warrant certificate or certificates of like tenor and Certificate representing an equivalent right or interest, but only upon receipt of evidence reasonably satisfactory to the Company of the such loss, thefttheft or destruction and, destruction in the case of a lost, stolen or mutilation of such destroyed Warrant andCertificate, indemnity, if requested, at also satisfactory to the cost and expense of the Warrantholder (Company, it being understood that in the case of loss, theft or destruction), an unsecured bond of R&R its corporate indemnity in form and amount reasonably satisfactory to the Companyshall be satisfactory. Such Applicants for such substitute Warrant certificate Certificates shall also comply with such other reasonable regulations and pay such reasonable charges as the Company may prescribe.
