Common use of Mutual Non-Solicitation of Employees Clause in Contracts

Mutual Non-Solicitation of Employees. (a) During the Restriction Period, the Executive, the RALI Entities and their respective affiliates shall not, directly or indirectly, contact, induce or solicit (or assist any person to contact, induce or solicit) for employment any person who (i) is, as of the Termination Date, an employee of the Company, ROP or any of their respective affiliates, or (ii) becomes an employee of the Company, ROP or any of their respective affiliates following the Termination Date, in each case, other than the individuals listed on Schedule B hereto. Notwithstanding the forgoing, a public solicitation not directed to employees of the Company, ROP or any of their respective affiliates shall not constitute a violation of this Section 3.3(a).
