Name Change by the Seller. The Seller shall deliver to Buyer, prior to the earlier of (x) the date 30 days from the date hereof and (y) the date of the release of funds from escrow provided for in the Consulting Agreement, evidence that it has changed its corporate name to a name that is dissimilar to, and not a variation of, North Point Cellular, Inc.
