Common use of Name of the Trust Clause in Contracts

Name of the Trust. The trust hereby created shall be known as the APMEX Physical β€” 1 oz. Gold Redeemable Trust or such other name as the Trustee may from time to time designate and the Trust may at any time adopt a French version of its name. Any mention of the name of the Trust herein shall refer to both the English and French forms of the name of the Trust, and insofar as may be practical, legal and convenient, the affairs of the Trust shall be conducted and transacted under that name, it being the intention that such name shall refer to the Trust and shall not refer to the Trustee or to the Unitholders.
