Common use of Nasdaq National Market Clause in Contracts

Nasdaq National Market. The Shares and the shares of Common Stock to be issued and sold pursuant to the Forward Agreements shall have been approved for inclusion on the Nasdaq National Market, subject only to official notice of issuance.
