Common use of Nature of Relationship; Subcontractors Clause in Contracts

Nature of Relationship; Subcontractors. RIB shall provide all Maintenance and Enhancements hereunder as an independent contractor to Customer. Subject to the provisions of this Agreement regarding confidentiality, RIB may perform its obligations hereunder through its employees and through subcontractors. Nothing contained herein shall be deemed to create any agency, partnership, joint venture, or other relationship between the parties or any of their affiliates, and neither party shall have the right, power, or authority under this Agreement to create any duty or obligation on behalf of the other party.
