Necessary Investments in Broadband Infrastructure. Xxxxxxx acknowledges and agrees that the funds provided pursuant to this Agreement shall be used to make necessary investments in broadband infrastructure. For the purposes of this Agreement, a “necessary investment in broadband infrastructure” is defined as one that is (1) responsive to an identified need to achieve or maintain an adequate minimum level of service and that may include a reasonable projection of increased need, whether due to population growth or otherwise; and (2) a cost-effective means for meeting that need, which takes into account available alternatives.
