Necessity of Court Approval. The Parties will seek the Court’s approval of this Class Settlement and will seek certification of the Settlement Class pursuant to Rule 23(b)(2) of the Federal Rules of Civil Procedure, with the opportunity for Settlement Class Members to opt out or exclude themselves from the Settlement. See Fed. R. Civ. P. 23(b)(2); see also Fed. R. Civ. P. 23(d)(1).
